Terms of Service
Last updated: 2026-09-18
These Terms of Service ("Terms") govern your access to and use of the CrestRate API and the https://crestrate.com website (together, the "Service"), operated by CrestRate ("we", "us"). By creating an account or calling the API you agree to these Terms.
1. The Service
The Service provides foreign-exchange reference rates aggregated from multiple third-party data sources, together with derived values such as merchant-selected rates and locked quotes.
The rates are reference data, not a dealable price. We are not a bank, money-services business, broker, or payment institution. We do not execute currency conversion, hold funds, or transfer money. Nothing in the Service constitutes financial, investment, tax, or legal advice.
The live demo on our website shows data delayed by one hour. It is provided for evaluation only and may not be used as a data feed or integrated into any product.
2. Accounts
You must provide a valid email address and verify it before API keys are issued. You are responsible for all activity under your account and for keeping your API keys secret. API keys are bearer credentials — anyone holding one can consume your quota. Notify us immediately at [email protected] if you believe a key has been exposed; you can revoke and reissue keys at any time from your dashboard.
One account per legal entity. Creating multiple accounts to obtain additional free quota is a breach of these Terms and we may suspend all affected accounts.
3. Plans, quotas and rate limits
Each plan carries a monthly request quota and a rate limit, published on our pricing page. Quotas reset at the start of each calendar month (UTC). Quotas and rate limits apply to your account as a whole: all API keys on the account share them.
Exceeding your quota results in requests being rejected with HTTP 429. We do not bill overage. You may upgrade at any time to raise your quota immediately.
We may change quotas, rate limits, and plan features. For paid plans, material reductions take effect no earlier than the start of your next billing period, and we will give you at least 30 days' notice by email.
4. Fees and billing
Paid plans are billed in advance, monthly or annually, through our payment processor Stripe. Prices are shown exclusive of tax unless stated otherwise; applicable VAT, consumption tax, or sales tax is added at checkout.
Subscriptions renew automatically until cancelled. You may cancel at any time from your dashboard; cancellation takes effect at the end of the current billing period and you retain access until then.
If a payment fails, we retry in line with our processor's schedule. Your plan remains active during a grace period after the period end; after that, the account reverts to the Free plan until payment succeeds. We do not delete your data because of a failed payment.
Refunds are governed by our Refund Policy.
5. Acceptable use
You may not:
- resell, redistribute, or sublicense the raw rate data as a standalone data feed, or build a competing rate-distribution service from it;
- circumvent quotas or rate limits, including by operating multiple accounts, sharing keys across unrelated entities, or rotating keys to evade metering;
- use the Service in a way that damages, overloads, or impairs it, or attempt to gain unauthorised access to it or to other customers' data;
- use the Service in violation of applicable law, including sanctions and export-control law.
Using rates inside your own product to price goods, settle orders, or display prices to your own customers is permitted and is the intended use.
6. Third-party data sources
Rates are derived from third-party providers. We do not control those providers and their
availability, accuracy, and terms may change. If a provider becomes unavailable, the Service
continues from remaining sources; the returned sources field always discloses, under stable
anonymous identifiers, which sources contributed to a given rate.
7. Availability
We aim for high availability but the Service is provided without an uptime commitment unless you have a separate written agreement with us. We may perform maintenance, and may suspend the Service where necessary to protect its security or integrity.
8. Accuracy and disclaimer
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement.
Rates may be delayed, incomplete, or incorrect. You are responsible for deciding whether a rate is fit for your purpose, and for applying your own controls — for example sanity limits, fallback rates, and reconciliation — before relying on it for money movement.
9. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of or relating to the Service.
Our total aggregate liability arising out of or relating to the Service is limited to the greater of (a) the fees you paid us in the twelve months before the event giving rise to the claim, or (b) USD 100.
Nothing in these Terms excludes liability that cannot be excluded under applicable law, including liability for fraud, death, or personal injury caused by negligence. If you are a consumer, your statutory rights are unaffected.
10. Indemnity
You will indemnify and hold us harmless against claims, damages, and reasonable costs arising from your use of the Service in breach of these Terms or applicable law.
11. Suspension and termination
You may stop using the Service at any time. To delete your account, email [email protected]; we process deletion requests within the periods set out in our Privacy Policy.
We may suspend or terminate your account for breach of these Terms, non-payment, or where required by law. Where practical we will give notice and an opportunity to cure.
On termination, your API keys stop working. Sections 8, 9, 10, and 13 survive termination.
12. Changes to these Terms
We may update these Terms. For material changes affecting paid customers we will give at least 30 days' notice by email. Continued use after the effective date constitutes acceptance.
13. Governing law and disputes
These Terms are governed by the laws of [To be provided], without regard to conflict-of-law rules. The courts of [To be provided] have exclusive jurisdiction, except that either party may seek injunctive relief in any competent court. If you are a consumer resident in a jurisdiction whose law grants you the right to bring proceedings locally, that right is unaffected.
